When is a birth injury considered medical malpractice?

A birth defect is likely more common than you think. According to the Centers for Disease Control and Prevention, roughly one in every 33 infants is born with a serious injury or medical condition, which is one of the leading causes of death among infants. Survey: Breast cancer is second-most misdiagnosed cancer

ABC News reported recently that a woman had a biopsy in 2006 and was soon diagnosed with breast cancer. The woman, whose mother and sister had breast cancer, chose to have a double mastectomy. However, she later found out that the doctors had misdiagnosed her: she never had cancer in the first place.
