Understanding the long-term consequences of brain trauma

Although it only takes a brief moment for a brain injury to occur, the aftereffects of an injury can last for several years or even longer. In some cases, brain trauma can be permanent and can change a person’s life forever. The Centers for Disease Control and Prevention reported that approximately 2.5 million people in Massachusetts and across the U.S. suffer symptoms of brain injuries that are serious enough for them to visit the emergency room, become hospitalized or even pass away.

A look at medication errors in America

A missed diagnosis, an incorrect diagnosis, oxygen deprivation during birth, and an instrument left inside a body are all examples of medical errors. Mistakes that involve prescription medications can also be involved in a medical malpractice claim. Psychology Today reports that an approximated 1.5 million patients in America experience injuries due to medication errors each year.

$1 million settlement in Vermont wrongful death case

In late 2015, Attorneys Jay O'Connor, Buffy Lord, and Chris Dodig teamed up to achieve a $1 million settlement of a wrongful death case on behalf of a family from Middlebury, Vermont. The case arose from a motor vehicle accident involving a large cement truck that occurred in Hancock, Vermont while the client was at work. As such, the case involved both a workers' compensation component and a traditional wrongful death claim based on negligence. The wrongful death claim alleged that the driver was negligent in his operation of the cement truck. It was also alleged that the employer was negligent in failing to maintain the large truck with adequate brakes or tires. While workers' compensation is generally the exclusive remedy for an injured employee, Donovan & O'Connor, LLP argued that exceptions to that rule applied in this case because the driver breached an independent duty he owed to the employee and that the employer was not shielded from liability because its actions in failing to maintain its vehicles were egregious and led to a substantial certainty of harm to its employee. The case was filed in the Rutland Superior Court and settled after mediation.

CDC says no drinking for women who are not on birth control

The potential effects of drinking alcohol while pregnant are well known, but some expectant mothers in Massachusetts may not fully realize the dangers or may have received a false negative about a pregnancy from a doctor, and as a result they may drink during a pregnancy’s early stages.
