Medical professionals are supposed to be just that: professionals. Patients in Massachusetts and across the country rely on their doctors, therapists and other medical providers to exercise a high standard of care. The couple has filed a complaint alleging that, in Aug. 2016, the wife was undergoing physical therapy, where she was instructed by a therapist to perform squats on a half-moon ball. When she did so, she apparently fell backwards and landed on the floor, causing her to fracture her lumbar vertebrae.
As a result, the complaint states that the woman suffered a number of bodily injuries, in addition to pain and suffering, disfigurement, disability and more. The lawsuit accuses the health system, the rehabilitation facility and others of a failure to exercise a professional standard of care and treatment. The plaintiff claims that the therapist, as an employee of the defendants, failed in her duty to properly supervise and instruct the patient in use of the equipment, and also failed to realize the risk of falling during the patient's session.
For the patient's pain and suffering, as well as the incurred medical expenses and the husband's claims of loss of consortium and companionship, the plaintiffs are requesting a judgment of over $15,000, in addition to all legal fees and any other relief as the court sees fit.
