REPRESENTATION OF LOCAL SKI AREAS For over 25 years
David B. Mongue has represented Jiminy Peak and a number of other local ski
areas in the defense of personal injury claims arising from skiing incidents
and summer recreational activities. He has tried in excess of 30 such cases
to successful jury verdicts. Several of these cases were reviewed and
upheld by the Massachusetts Supreme Judicial Court.
COMMERCIAL WIND ENERGY FACILITY Stephen N. Pagnotta
represented enXco, Inc., a national wind energy company which sought to
build Massachusetts' first commercial scale wind energy facility. Stephen
and others at Donovan & O'Connor, LLP negotiated with landowners, drafted
land use agreements and successfully represented enXco before the permitting
boards of the towns of Florida and Monroe, MA. At peak capacity, this
project will produce enough emission-free electric power to service
approximately 9,500 homes.
PURCHASE OF HISTORIC INN Gordon P. Black and Stephen
F. Narey represented Billy and Pat Soto with respect to their purchase of
the historic Village Inn in Lenox, Massachusetts. Donovan & O’Connor
facilitated all aspects of this transaction for the buyers, including
negotiation of the purchase and sale agreement, financing and licensing.
The Sotos are currently in the process of upgrading the restaurant and
tavern located in the inn to include a first class wine cellar.
SALE OF FRANCHISE MOTEL Partner Gordon Black and
associate Stephen Narey represented the owners of a local franchise motel in
the $3.5 million sale of the motel's real property and assets. Attorneys
Black and Narey served as the sellers' corporate counsel in many aspects of
the project, including franchise agreements, lease agreements, due diligence
review and obtaining local government approval.
PURCHASE OF PLASTICS COMPANY Philip Grandchamp, a
partner in our transactions department, recently represented a local
entrepeneur in successful negotiations to purchase an area plastics
business. The purchase of the Pittsfield-based business, which had been
slated for closure by its out-of-state parent company, resulted in more than
40 area jobs being saved.
SALE OF NATIONAL RECORDS CENTER Donovan & O'Connor,
LLP advised the owner and performed the work necessary in connection with
the recent mulit-million dollar transaction involving the sale of the Silvio
O. Conte National Records Center in Pittsfield. The firm's newly upgraded
computer technology facilitated the successful completion of the deal.
